Item Protecția drepturilor clienților în domeniul financiar-bancar(CEP USM, 2024) Guzun, AdrianTimp de secole, au fost promulgate diferite legi pentru a proteja consumatorii, bazându-se pe diverse forme juridice pentru a-și atinge obiectivele. Aceste legi urmăresc să asigure corectitudinea, siguranța și transparența în tranzacțiile cu consumatorii. Pe lângă legile concepute special pentru protecția consumatorilor, multe alte prevederi legale protejează indirect consumatorii. De exemplu, legile care simplifică urmărirea penală a fraudei, protejează drepturile de proprietate sau facilitează litigiile servesc, de asemenea, la protejarea intereselor consumatorilor. Din cauza acestei suprapuneri, limitele legii privind protecția consumatorilor nu sunt ușor de definit, acestea fiind distincte în diferite țări. Acest articol se concentrează în primul rând pe legislația din aria protecției consumatorilor ca obiectiv principal și oferă o introducere a mecanismelor legale existente pentru protejarea consumatorilor în aria financiar-bancară la nivel internațional, inclusiv din perspectiva protecției datelor cu caracter personal.Item Some comparative law aspects of citizenship legislation in the Republic of Moldova and Romania(CEP USM, 2024-11-07) Tinu, AndreiWith a Romanian historical and cultural background, with a common futu- re within the Euro-Atlantic bodies, Romania and the Republic of Moldova continue the effort of democratization and harmonization of national legislation with the community acquis, the amendments and adaptations also targeting legal procedures and technical conditions for their fulfilment. The electronic certificate, the collection of biometric data, the reduction or, where appropriate, an increase in the processing time for applications for naturalization or recognition of citizenship are elements which are or will be part of the legislation on citizenship in the Republic of Moldova and Romania.Item Echitatea socială – obiectiv primordial al Parlamentului Republicii Moldova(CEP USM, 2024) Guceac, Ion; Cuciurca, DoinaThis study describes several issues related to the role of parliaments in improving governance, particularly in public service delivery and poverty reduction. Drawing on functions of representation, lawmaking and control, parliaments are uniquely positioned to understand and control the impact of poverty and to serve as a bridge between government, the private sector and civil society. The role of Parliament in planning strategies to combat poverty, promoting active social participation in economic development, is highlighted. Parliamentarians can contribute to national efforts to reduce poverty by studying and highlighting the results of the fight against poverty, participating in the creation of a new initiative to eradicate it, and providing oversight during the implementation of government programs. As circumstances that attribute to parliaments the key role in combating poverty are mentioned: the representation of the electorate and its interests; adoption of current legislation to support development; parliamentary control over the activity of the executive - its effectiveness and responsiveness to the needs of members of society, especially the poor.Item Fundamente jurisprudențiale în materia sportului: practica Curții Europene a Drepturilor Omului(CEP USM, 2024) Televca, OlegIn this article we will refer to the practice of the European Court of Human Rights in the field of sports. One of the priority areas in this agreement represents the area of the environment, which includes waste management. In this field, the EU adopted several directives, some of which should be transposed into the national legislation of the Republic of Moldova. The European Union has the power to legislate in those areas of competence transferred by member states through treaties that voluntarily limit their sovereign rights. Human life has thus obtained a central position within treaties, among which, the European Convention on Human Rights. The Republic of Moldova, following its membership to the Council of Europe and its ratification of the Convention, has committed to respect all the rights guaranteed by the latter, including the right to life.However, over the years, the state has failed to exercise its obligation fully, as the European Court of Human Rights has found violations which resulted in Moldova’s conviction. The article aims to analyze the cases lost by Moldova,which are relevant to the topic, as well as the position of the Supreme Court of Justice and the Constitutional Court on the matter.Item MIGRATION OF THE MOLDOVANS WITHIN EUROPEAN UNION BORDERS VS RUSSIAN FEDERATION(2012) Cara-Rusnac, AlionaÎn articolul dat se descriu tendinţele migrării cetăţenilor Republicii Moldova în ţările Uniunii Europene (UE) şi Federaţia Rusă, precum şi în alte ţări. Acest fenomen a devenit un eveniment obişnuit pentru ţara noastră. Autorităţile centrale închid ochii la migraţia masivă al cetăţenilor noştri peste hotarele ţării, mai mult ca atât remitenţele trimise de peste hotare de emigranţii din Moldova sunt o contribuţie esenţială al bugetului nostru. ţările Uniunii Europene (de exemplu Italia, Grecia) nu au încheiate contracte bilaterale cu Republica Moldova în vederea reglementării statutului imigranţilor şi asistenţei lor, pe teritoriul Federaţiei Ruse cetăţenii Republicii Moldova nu se simt mai în siguranţă ba chiar situaţia acestora e mai rea. După datele statistice, în prezent în ţările UE lucrează şi domiciliază mai mult de 20 mln de migranţi din diferite ţări, dintre care jumătate de milion sunt moldoveni. Moldova îşi pierde potenţialul intelectual, afirmă oficialii europeni, referindu-se la cifrele statistice, în conformitate cu care 40% de persoane apte de muncă emigrează din ţară. Migrarea cetăţenilor prezintă un pericol real pentru Republica Moldova. Datele statistice arată că 40% din populaţia aptă de muncă munceşte peste hotarele ţării şi aduce contribuţii în bugetul altor ţări, în timp ce Republica Moldova întâmpină greutăţi financiare mari. Aproape jumătate din moldoveni emigraţi peste hotarele ţării au preferat de a pleca în fostele ţări ale Uniunii Sovietice, în mod special în Rusia şi Ucraina. Anual în Rusia emigrează 2-3 mii de persoane, iar în Ucraina 1,5 -2 mii de persoane. Pe lângă toate, persoanele aleg fostele ţări ale Uniunii Sovietice deoarece în fostul spaţiu sovietic predominant populaţia cunoaşte şi limba rusă – o limbă ce a fost vorbită de practic toate ţările sovietice. Ca rezultat persoanele mai uşor se integrează în societate.Item PARTICULARITĂŢI DE CONSTITUIRE A SUBIECTELOR ACTIVITĂŢII DE ÎNTREPRINZĂTOR(CEP USM, 2021) Ciubotaru, AngelaLe premier acte normatif dans la Republique de Moldova qui a reglemente l’etablissement des sujets de l’activite entrepreneuriale a ete le Reglement des entreprises economiques nr.500 du 10.09.1991 (actuellement abrogue). Il est interessant de noter que le Reglement des societes economiques n’a pas ete publie dans le Journal Officiel. La diffusion de l’acte normatif aux pouvoirs publics s’est faite par le biais de circulaires gouvernementales. Par l’expression «sujets d’activite entrepreneuriale», nous entendons «entrepreneurs » et les deux notions ont le meme sens, etant synonymes. Cependant, dans la legislation de la Republique de Moldova, on trouve une troisieme notion, celle d’agent economique.
