Abstract

Abordarea conceptului de competenţă teritorială a statului nu poate fi separată de suveranitate. Complexitatea ambelor concepte a determinat geneza diverselor teorii, care diferă, fie de criteriu de raportare, fie de modul de exercitare sau negare a acesteia. Pe fonul transformărilor esenţiale pe plan internaţional din perioada interşi post-belică, legate de procesul de eliberare socială şi naţională, a dus la apariţia de noi state naţionale pe fostele teritorii coloniale, abordările doctrinare nu mai sunt atât de categorice în privinţa negării în totalitate a suveranităţii.
