Abstract
The dismissal of employees due to a reduction in the number or staff numbers is a very complicated procedure regulated by several articles of the Labor Code. When applying this ground for dismissal, the employer must comply with the provisions of art. 42, 42/1, 88, 183, 184 and 186 Labor Code. The procedure itself includes a series of guarantees for employees, and if at least one legal provision is violated, the dismissal order can be canceled by court decision. The regulation of the procedure for the dismissal of employees due to a reduction in the number or staff numbers aims to prevent any abuses on the part of the employer, so as to avoid fictitious reductions in staff numbers.
