Suspendarea dreptului de utilizare a vehiculului rutier [Articol]

Abstract

This article analyzes one of the coercive procedural measures regulated by the Contravention Code of the Republic of Moldova, i.e., the suspension of the right to use the road vehicle. This measure consists in the temporary prohibition of the natural person and/or the legal person to use a certain road vehicle by withholding the plates with the registration number and the registration certificate. It can be applied in case the person (driver) used the vehicle to commit a contravention regarding the violation of the rules for the road transport of people and goods, the violation of the rules of the traffic of dangerous goods, as well as the commission of a contravention regarding the violation of the rules of road use to vehicle traffic. In this context, the question arises whether or not the suspension of the right to use the road vehicle violates the right to property. The answer is negative.
