Abstract

This paper compares the new amendments to Article 324 of the Criminal Code of the Republic of Moldova, which entered into force on September 7, 2024, with the previous provisions, analyzing their impact. The amendments are aimed at eliminating some aggravating factors and adjusting the sanctions for passive corruption, including both increasing and reducing the penalties for certain categories of subjects. The paper emphasizes the threshold of 5000 lei, considered excessive, below which deprivation of liberty does not apply, drawing attention to the potential negative impact on the deterrence of corruption. It also discusses the issue of passive corruption and the negative consequences it has on the state and society, emphasizing the need for stronger measures to prevent and combat this phenomenon.
