Împăcarea victimei cu făptuitorul – cauză care înlătură răspunderea contravențională [Articol]

Abstract

The legislator established certain causes that exclude contraventional liability, by removing them, and in the given situation we are in the presence of one/some contraventions committed, however, the perpetrator as a result of certain conditions is not attracted to contraventional liability. They are a category of misdemeanors where the victim can be, namely: in the case of insult when the honor, dignity of the person or their moral-psychological state is threatened (moral damage) or in the case of bodily integrity damage when the person’s state of health is threatened (physical damage), or in the case of intentional damage/destruction of foreign property by attacking the property right or other real rights of the victim over his property (material damage). Reconciliation between the victim and the perpetrator can be at different stages, respective¬ly, it is not reached when the complaint is not filed, and the investigating officer cannot initiate the contravention case, or when the complaint was initially filed, the contravention process started, and, subsequently, by withdrawing the complaint, it ceases.
