Noi orizonturi în reglementarea răspunderii pentru infracțiunile contra justiției [Articol]

Abstract

Law No. 136/2024 concerns, among other issues, several key provisions in Chapter XIV “Crimes Against Justice” of the Criminal Code of the Republic of Moldova. To assess the impact of these amendments, an analysis was conducted on art. 303, 3031, 307, 308, 312–314, 315, and 322 of the Criminal Code of the Republic of Moldova. As a result of the analysis, it can be stated that the amendments made by Law no. 136/2024 to Chapter XIV of the special part of the Criminal Code of the Republic of Moldova are mostly beneficial. The only vulnerability lies in the lack of an official interpretation with sufficient authority of the phrase “imperative legal norms”, which is used in art. 307 and 308 of the Criminal Code of the Republic of Moldova. The lack of such an interpretation could jeopardize the application of these articles in accordance with the principle of legality.
