Abstract

This research discusses the consequences of criminal and misdemeanor liability, which is criminal law, applying the principle of legality of incrimination, the basis of civil liability which is, in a correlative way, civil law, respectively tortious civil liability [1] (the two legal forms of liability, no they are mutually exclusive, because their coexistence is possible) and obviously the “ne bis in idem” principle which stipulates that no one can be prosecuted or punished twice for the same crime, in the field of infringement of intellectual property rights.
