Trecerea ilegală a frontierei prin prisma dreptului penal comparat

Abstract

The state border establishes the spatial limits of action of state sovereignty. Although during historical periods the state borders have been reconfirmed, modified, changed, etc. several times, and international law establishing clear rules of intervention, the present demonstrates a different reality, both through the lens of internationally recognized normative acts, and through from the perspective of national criminal legislation, legislation that differs from state to state, involving several issues of legal-criminal qualification of illegal border crossing, in fact, these facts having a transnational character. It follows from the legislation of the Republic of Moldova that the western part of the Republic of Moldova borders with Romania, and the eastern part with Ukraine. Simple and clear, when the reality is completely different.
