Abstract

The status of the subject of criminal proceedings implies the existence of rights and obligations, on the basis of which this subject exercises a procedural function and participates in the criminal procedural legal relations. The logical, systemic and grammatical method of researching the legislation in this field allows to identify the volume of rights and obligations enforceable against the undercover agent in order to establish his procedural guarantees and the limits of the functional powers of the procedural subject. Therefore, we aimed to identify the rights and obligations, the procedural guarantees that the undercover agent acquires, once the special investigative measure in the form of an undercover investigation is ordered, organized and carried out.
