NECESITATEA SPECIALIZĂRII INSTANŢELOR COMPETENTE ÎN MATERIE DE INSOLVABILTIATE

Abstract

Specializarea judecătorilor este privită ca un imperativ al timpului, deoarece justiţiabilii îşi doresc ca litigiile lor să fie soluţionate cu celeritate şi profesionalism pentru a limita la maximum riscul de erori judiciare. Analiza legislaţiei din România şi din Republica Moldova demonstrează că dispoziţiile legale cu privire la specializarea instanţelor și/sau a judecătorilor în domeniul insolvabilităţii lasă de dorit. Deşi o specializare îngustă a judecătorilor ar impune cheltuieli mari, totuşi ajungem la concluzia că o reducere a numărului categoriilor de dosare, aflate în procedura aceluiaşi judecător, ori atribuirea doar a unor categorii de dosare ar contribui la îmbunătăţirea actului de justiţie în domeniul insolvabilităţii.The specialization of judges is seen as a need of these times, because the parts of the process they want as their disputes to be resolved with swiftness and professionalism in order to limit the risk of miscarriages of Justice. Analysis of the legislation of Romania and Republic of Moldova legislation demonstrates that the legal provisions regarding the courts and/ or specialization of judges in the field of insolvency is poor. Although, a more pronounced specialisation of judges would impose major spending, yet we come to the conclusion that a reduction in the number of categories of cases in the same competent judge, or the assignment of certain categories of cases by some judges, would contribute to the improvement of Justice in the field of insolvency.
