Abstract

From the perspective of the judge’s disciplinary liability, we emphasize the need to achieve a balance between the desire to sanction the judge and the need to respect his independence. Maintaining this balance is possible by understanding the concept of the judge’s independence by highlighting the national legal framework, as well as identifying the facts that can be treated as disciplinary violations in the activity performed by the judge.
