Item Paradigma dreptului la vot în contextul integrării europene [Articol](Editura USM, 2025) Slusarenco, SvetlanaThe constitutions of contemporary states declare the people as the holders of national sovereignty. Citizens, exercising sovereignty through the right to vote, act not in their own name, as holders of a share of sovereignty, but in the name of the people they represent at that moment. European integration involves the process of collaboration and coordination between the member states of the European Union to build a common economic, political and social space. The paradigm of the right to vote in this context refers to the way in which citizens of the member states exercise their right to vote and how European integration influences and is influenced by this right. The exercise of the right to vote in the European space, both in the European Parliament and in local elections, is carried out by citizens who hold the citizenship of one of the member states of the European Union.Item Libertatea de exprimare a mass-media în perioada electorală în jurisprudenţa Curţii Constituţionale a Republicii Moldova [Articol](Editura USM, 2025) Țurcan, SergheiFreedom of expression is a fundamental right and is an essential element of a democratic society. Freedom of the press gives the public a means to form an opinion on political ideas. The mass media has an important influence in contemporary society: it not only informs, but can suggest, through the way it presents information, how this information should be evaluated. These findings are also valid in the case of media coverage of the elections. During the electoral period, the mass media has the obligation to respect the principles of fairness, balance and impartiality in covering the elections, to inform the public correctly and objectively, to ensure equal opportunities for electoral competitors and a plurality of opinions that reflect the diversity of political opinions in the country.Item Principiile care guvernează procesul electoral în Republica Moldova(2021) Smochină, Andrei; Cebanu, IonThis article elucidates the main legal regulations on the electoral process that were provided by the main electoral law of the Republic of Moldova — the Electoral Code and the amendments to this law from 1997 to the present. We placed special emphasis on the principles governing the organization and conduct of elections in the Republic of Moldova. We consider these fundamental ideas as the basis of the electoral legislation from which the whole democratic process on which the whole mechanism of the state apparatus is based should start.Item Soluționarea litigiilor electorale – element de realizare a garanțiilor constituționale ale drepturilor electorale ale cetățenilor(2019) Guceac, IonThe present scientific article focuses on the principle of national sovereignty consecrated in the Constitution of the Republic of Moldova (art. 2), which ensures the realization of the fundamental human and citizen rights to elect and be elected. These rights are realized within elections, which must take place in such conditions that their exercise would provide the best possible representation capable of delegating the best governance. The good organization of elections also depends on how the stages of the electoral process take place, including the actions related to the requests solving made by the subjects of the electoral process against the irregularities in the course of the electoral process. All these require a scientific approach to electoral litigations, whose resolution depends the quality on the representatives elected by the people. Problema care s-a pus şi se pune este de a găsi un mecanism juridico-statal cât mai eficace în a realiza acest scop, fără a atenta la suveranitatea naţională. Practica contemporană constituţională a dat răspuns la această întrebare prin elaborarea şi argumentarea sistemelor electorale capabile să nu rupă această legătură dintre suveranitatea naţională şi reprezentare. Problema care s-a pus și se pune este de a găsi un mecanism juridico-statal cât mai eficace în a realiza acest scop, fără a atenta la suveranitatea naţională. Practica contemporană constituţională a dat răspuns la această întrebare prin elaborarea și argumentarea sistemelor electorale capabile să nu rupă această legătură dintre suveranitatea naţională și reprezentare. Urmează să elucidăm dacă modificarea sistemului electoral în Republica Moldova se încadrează în această armonie. Totodată, autorii au identificat problemele reglementării juridice a legislației naționale, care constată responsabilitatea pentru falsificarea rezultatelor alegerilor.
