SOLUŢIONAREA LITIGIILOR ELECTORALE - ELEMENT DE REALIZARE A GARANŢIILOR CONSTITUŢIONALE ALE DREPTURILOR ELECTORALE ALE CETĂŢENILOR

Abstract

The present scientific article focuses on the principle of national sovereignty consecrated in the Constitution of the Republic of Moldova (art. 2), which ensures the realization of the fundamental human and citizen rights to elect and be elected. These rights are realized within elections, which must take place in such conditions that their exercise would provide the best possible representation capable of delegating the best governance. The good organization of elections also depends on how the stages of the electoral process take place, including the actions related to the requests solving made by the subjects of the electoral process against the irregularities in the course of the electoral process. All these require a scientific approach to electoral litigations, whose resolution depends the quality on the representatives elected by the people. Finally, the author proposes the creation of specialized courts for the examination of electoral litigations.
