Item Contemporaneitatea şi novaţiile contractului internaţional de transport rutier de mărfuri – perspective şi provocări(CEP USM, 2024-09-20) Bajurea-Ostrofeţ, ElenaThe purpose of this paper is to describe the main challenges which confronts the applicability of the contract for the international carriage of goods by road, as well as the resilience measures adopted in response to them. The aims of this research cover the innovative perspective analysis of the contract for the international carriage of goods by road. Its novelty consists in the research of the legislation adopted to fight with the consequences of the challenges which affect the applicability of the contract for the international carriage of goods by road. Its novelty is described by the atypical way of the methods' analysis – through practical applications. The implementation of the scientific results will be realized through the future development of the theoretical foundations and practical aspects in the content of the doctoral dissertation mentioned above.Item Fundamentele progresismului în materia transportului internaţional rutier de mărfuri(CEP USM, 2024-11-07) Bajurea-Ostrofeţ, ElenaThe present research expresses a high importance for the research domain of the international transport of goods by road, starting with the point that this paper analyses the latest international regulation with a view on digitalisation of the procedures related to the international transport of goods by road, which entered into force in 2020 and will start being applied in the EU space from August 21, 2024. This aim, as well as the purposes as: research of the genesis of the progressive steps in the field of international road freight transport and inquiry other the digitalised instruments derived from T.I.R. and A.T.A. carnets, create a framework over the evolution of the legal provisions related to the mentioned domain. The research methods, such as the comparative, legal and historical ones, showed their value while describing the main result of this paper, which lead to a terse analyse of the main achievements of the international law givers in the field of international transport of goods by road.Item Armonizarea drepturilui internațional privat al Republicii Moldova cu legislația Uniunii Europene(Print-Caro, 2023-03-15) Dodon, AdrianaThe EU integration process is an important step forward for the Republic of Moldova. One of the best ways to become closer to the EU is to amend the national legislation to the European unique legislative framework. The legal approximation was a turning point in regard to new regulations upon private international law, as the Civil code was significantly amended in 2019. The process of legal approximation implies the use of methods and techniques for transposing EU legislation into Moldova's national legislation. The main purpose of legal approximation for civil relations in private international law, for example, is to ensure the is a uniform regulation to the same kind of subjects, within different countries or citizenships.Item Transportul rutier transfrontalier profesionist de numerar în Euro între statele –membre ale eurosistemului(2013) Gribincea, LiliaPentru înlăturarea diferențelor semnificative dintre legislațiile naționale ale statelor-membre și pentru facilitarea efectuării transporturilor rutiere transfrontaliere profesioniste de numerar în euro între statele-membre ale Eurosistemului, a fost adoptat Regulamentul (UE) nr. 1214/2011 al Parlamentului European și al Consiliului din 16.11.2011 privind transportul rutier transfrontalier profesionist de numerar în euro între statele-membre din zona euro, în vigoare din 29.11.2012. Acest transport este efectuat cu un vehicul CIT. Pentru obținerea licenței CIT, societatea solicitantă trebuie să îndeplineascvă anumite condiții.Item SCRISOAREA DE TRĂSURĂ ȘI LICENȚA UNIONALĂ - INSTRUMENTE CONFIRMATIVE PRIVIND EXECUTAREA CONTRACTULUI DE TRANSPORT RUTIER INTERNAȚIONAL DE MĂRFURI PE TERITORIUL UNIUNII EUROPENE(CEP USM, 2023) Bajurea-Ostrofeț, ElenaPrezentul articol înglobează caracteristicele și modalitatea de funcționare a raportului scrisoarea de trăsură – licență comunitară în cadrul efectuării operațiunilor de transport rutier internațional de mărfuri inclusiv pe teritoriul Uniunii Europene. În condițiile în care licența comunitară poate fi identificată în calitate de analog al autorizației C.E.M.T., eliberată în exclusivitate pe teritoriul Uniunii Europene, descrierea conținutului, particularităților, precum și modului de obținere a acesteia constituie un aspect care prezintă interes pentru studiul legislației Uniunii Europene în domeniul transportului internațional rutier de mărfuri. Întrucât în lipsa acesteia, scrisoarea de trăsură nu poate produce efecte juridice pe teritoriul spațiului comunitar, se atestă necesitatea examinării speței nominalizate prin prisma cadrului multilateral existent și a legislației Uniunii Europene care reglementează operațiunile de transport internațional rutier de mărfuri.
