Item Barierele utilizării medierii în Republica Moldova(CEP USM, 2024-11-07) Chifa, Felicia; Gavrilă, Constantin-AdiThe implementation of mediation in the Moldova Republic faces significant barriers, both subjective and objective. Subjectively, the low level of legal awareness among citizens limits their understanding, respect and acceptance of mediation’s benefits. Objectively, the lack of an enabling system, a rather incoherent and unstable legislative framework, as well as insufficient regulations for mediators hinder effective mediation. Financial barriers, such as high office costs for mediators and low income, also discourage the practice. Additionally, insufficient promotion and the absence of a unified mediator community further diminish public trust and utilization of mediation. Overcoming these challenges requires comprehensive measures, including public education, legislative reforms, and financial support for mediators, to make mediation a viable and efficient method of dispute resolution in Moldova.Item Degrevarea de probaţiune în temeiul faptelor unanim cunoscute (de notorietate publică)(2007) Chifa, Felicia; Cojuhari, AlexandruAs a first condition of justice there appears the necessity to ascertain by the Court the de facto circumstances that took place before the case opening, while its cognizance can be realized through the probation activity. In the procedural legislation of Republic of Moldova and of the other states there are facts that, even they are part of the probation object, which do not need to be proved. Thus, the Court of Justice can consider certain facts as ascertained without submitting them to probation, if they are well known facts. At the same time, the procedural legislation that is reported on the subject is incomplete and needs to be made up with special provisions that will assure the correct interpretation and the uniform application of the well known facts. Nevertheless, it will facilitate the ascertained fact activity of the important circumstances for a fair solution of the civil cases, will encourage their judgment in reasonable terms and will reduce expenses met by the state and by the participants.Item Particularităţile probaţiunii faptelor negative în procesul civil(2009) Chifa, FeliciaItem Particularitățile sarcinii probațiunii în procedura specială(2023) Chifa, FeliciaO condiţie esenţială pentru emiterea unei hotărâri judecătoreşti legale şi întemeiate este stabilirea circumstanţelor importante pentru cauză, care sunt constatate prin procesul de probaţiune. Sarcina probaţiunii reprezintă obligaţia ce incubă unui participant la proces de a dovedi anumite circumstanţe de fapt, modalitatea de repartizare a cărora depinde de felul de procedură civilă. Reieşind din specificul procedurii speciale, putem afirma că sarcina probaţiunii îi revine, în general, petiţionarului şi doar subsidiar – persoanei interesate, care nu va suporta consecinţe negative directe în respectivul proces. The mediator is a third party specialised in dispute resolution who facilitates negotiations between the parties. The legislation regarding mediation regulates the way the mediation process is carried out, so that the best interest of the child is ensured. Mediation has numerous legal, economic, social and psychological advantages, compared to other ways of resolving disputes. Due to its numerous advantages, mediation is the most appropriate way of resolving conflicts in which children are involved, especially family disputes and criminal conflicts.Item Particularităţile repartizării sarcinii probaţiunii de felul de procedură(CEP USM, 2024) Chifa, FeliciaAn essential condition for issuing a valid and well-founded judicial decision is the establishment of crucial circumstances relevant to the case, which are determined through the process of evidence. The fair resolution of a case always on the accurate identification of the subject matter of evidence and the verification of significant facts. In this context, the burden of proof represents the obligation assigned to a participant in the legal process to substantiate specific factual circumstances. The general rule governing the allocation of the burden of proof, which dictates that each party must substantiate the circumstances they invoke as the basis for their claims and objections, entails certain intricacies in different types of procedures, and even in the adjudication of specific case types, alternative rules for allocating the burden of proof are established.Item TEMEIURILE DEGREVĂRII DE PROBAȚIUNE(CEP USM, 2020) Chifa, FeliciaThe important facts for the fair settlement of the civil case become known through the activity of probation, at the same time according to the procedural law, there are facts, which although they are important for the cause, do not need to be proven. The Civil Procedural Code stipulates in art.123 that the participant of a civil trial will be released from the obligation of probation if the facts are unanimously known, are established by an irrevocable court decision. Furthermore, from art.131 par.
