Thus, it was mentioned that, unlike civil legal capacity, the legal capacity subjected to the research, has an unitary character, and therefore, it cannot be fragmented in the ability of use and of exercise. But privacy can not be regarded as an absolute right, and when faced with fundamental rights (freedom of expression, guaranteed by the provisions of art. 32 of the Constitution) must find a balance in respect thereof, being of equal importance. Thus, by this article is proposed to evidence the necessity to establish a balance between the rights from labour field with those from personal field.Item DREPTUL DE NEGOCIERE COLECTIVĂ PRIN PRISMA INSTRUMENTELOR INTERNAŢIONALE ŞI A LEGISLAŢIEI NAŢIONALE A REPUBLICII MOLDOVA(2013) Romandaș, Nicolae; Boișteanu, EduardThe right of workers to bargain collectively is a fundamental right, which is recognized in the Constitution of the International Labour Organisation (ILO) and the Declaration of Philadelphia annexed to the ILO Constitution. The legal protection of the right to collective bargaining is the key to the representation of collective interests. It builds on freedom of association and renders collective representation meaningful. Collective bargaining can play an important role in enhancing enterprise performance, managing change and building harmonious industrial relations. Combinatul Poligrafic, 2020-05-22) Boișteanu, Eduard; Romandaș, NicolaeSpecialty literature indicated that the suspension of the individual employment agreement assumes the cessation of the work supply by the employee and accordingly of the payment of the wage rights by the employer, with the resumption of the fulfilling of these obligations after a certain period of time. In this article the authors elucidated the characteristic features and the specific effects of the suspension of the individual employment agreement. Combinatul Poligrafic, 2020-05-22) Romandaș, Nicolae; Boișteanu, EduardThe content of this scientific communication is dedicated to the institution of elected representatives of employees which is recognized as an alternative to trade unions (according to the law, in organizations without trade unions, the interests of employees can be defended by their elected representatives. Therefore, the coexistence of these two legal institutions is excluded). In this regard, national and EU legislation was analyzed, highlighting the positives and negatives. Interpreting the legal provisions, we analyzed the notion of „elected representatives of employees” who are appointed those employees elected at the general meeting (conference) of employees in units within which no trade unions are formed to promote and defend the interests of employees. Reference was made to their attributions, mentioning that the collective rights (the right to administer the unit, to conduct collective bargaining, etc.) can be exercised by the elected representatives of the employees. All these problems of technical-juridical type must be The Republic of Moldova. The individual labor contract with the chief of the unity is made on the period indicated in the documents of constitution of the unity or on a term established in the contract by the agreement of the parts. It is important to keep attention on the fact that the data about the administrator of the commercial society are written in the State Register of the juridical persons.Item UNELE REFLECŢII JURIDICE PRIVIND DREPTUL ANGAJATORULUI DE A-ŞI REVOCA ORDINUL DE CONCEDIERE A SALARIATULUI(2017) Boișteanu, Eduard; Romandaș, NicolaeThe idea of cancellation of the employer’s unilateral legal acts has been advanced in the specialty literature. This article clarifies the legal status of cancellation of the dismissal order (command, decision, act) by the employer. In addition, there have been highlighted the conditions to be cumulatively met in order to validate such a cancellation act. Based on the research performed, the authors concluded that the employer can cancel the order (command, decision, act) of dismissal of the employee only after obtaining the written agreement of the former employee as the unilateral cancellation cannot produce legal effects.Item UNELE REFLECŢII JURIDICE PRIVIND MODELAREA DECIZIILOR ANGAJATORULUI ÎN SEGMENTUL RESURSELOR UMANE ÎN VEDEREA OPTIMIZĂRII CHELTUIELILOR PENTRU PERSONALUL ANGAJAT(2011) Romandaș, Nicolae; Boișteanu, EduardDans Ies conditions de la recession et de ia stagnation economiques, beaucoup de a commei Qants sontforces de revoirleurs decisions degestion relatives au personnel employe 73 afin d'optimiser Ies couts d'entretien de celui-ci. Ainsi, selon Ies dispositions du Code du Travail de la Republique de Moldavie, Ies employeurs peuvent utiliser Ies operations et Ies techniques juridiques suivantes: licenciement des employes r cause de la reduction du 47 personnel; reduction du montant des salaires de fonction ou de charge; application du regime de travail r temps pârtiei; suspension des contrats individuels de travail en cas de chomage technique; obligation des employes de rediger des demandes de conge sans remuneration. Beaucoup d 'employeurs considerent, tort, que ces operations peuvent etre rialisees sans condition etsans prendre en compte les stipulations de la legislation du travail. Nous soulignons que toute decision prise dans ce cas devrait etre en stride conformite avec le Code du Travail de la Republique de Moldavie et d 'autres actes normatifs dans le domaine.Item UNELE REFLECŢII PRIVIND METODA DE REGLEMENTARE JURIDICĂ A DREPTULUI MUNCII(2012) Romandaș, Nicolae; Boișteanu, EduardThis article reflects the aspects of the method of legal regulation of labor law which are complex and dynamic. To elucidate this issue, references to the author’s opinion towards this subject were made, and specific features and characteristics were found. In this context, were overlooked the specific characteristics of the method of legal regulation of labor law. As a conclusion to the subject, we appreciate that the method of legal regulation of labor law has a dichotomous nature in that it is divided in the method of coordination for collective relations and the method of ordering the individual employment relationship.Item UNELE REGLEMENTĂRI PRIVIND STATUTUL SALARIATULUI ÎN CALITATE DE SUBIECT AL DREPTULUI MUNCII(Print-Caro SRL, 2021) Romandaș, Nicolae; Boișteanu, EduardThe article presents an extensive research of the legal status of the employee as a subject of labor law. In this context, we refer to the national legislation, the legislation of other countries, the legal doctrine and the European legal practice. The notion of em- ployee is commented and the interference between civil capacity and work capacity, the common sides and delimitations are highlighted. Other authors’ opinions are exposed vis-à-vis the discussed topic. The legal effects, which arise as consequence of recogniti- on of limited or reduced legal capacities, are touched upon.
