TENDINȚE ACTUALE DE PRESTARE A MUNCII ÎN BAZA CONTRACTELOR CIVILE ÎN RAPORT CU CONTRACTELE DE MUNCĂ

Abstract

Scopul și obiectivele lucrării: Scopul tezei constă în abordarea complexă a fenomenului prestării muncii în baza contractelor de muncă și a celor civile, precum și cercetarea fenomenului muncii prestate de către liberii profesioniști prin prisma instrumentelor internaționale în domeniu, a legislației naționale, dar și a opiniilor doctrinare. De asemenea, s-a propus ca obiectiv, scoaterea în evidență a trăsăturilor distinctive ale contractelor civile față de contractele de muncă, oportunitatea încheierii unui contract de muncă sau a unui contract civil pentru prestarea unei munci concrete, precum și înaintarea unor propuneri de perfecționare a legislației naționale în domeniu.Purpose and objectives of the thesis: The purpose of the thesis consist of the complex approach of the phenomenon of labor supply based on employment and civil agreements, as well as the study of the phenomenon of labor supplied by people with liberal professions through international instruments, national legislation as well as the doctrinal views. It has also been aimed at highlighting distinctive characteristics of civil agreements towards employment agreements, as well as the opportunity of using an employment or a civil agreement for a certain labor supply, as well as submitting proposals for the modernization of the national legislation.Цель и задачи диссертации. Цель диссертации состоит в комплексном исследовании феномена выполнения труда на основе трудовых и смежных гражданско-правовых договоров, а также выполнения труда людьми свободных профессий с точки зрения международно-правовых документов, национального законодательства и доктринальных взглядов. Было также предложено в качестве задачи выделение отличительных черт трудовых договоров по сравнению со смежными гражданско-правовыми договорами о труде, определение целесообразности применения трудового или гражданского договора для выполнения конкретного труда, а также представление предложений по модернизации национального законодательства в данной области.
