Abstract

In this article the authors analyse the procedural aspects of the examination by the courts of the requests submitted through writ proceedings by police, the State Fiscal Service regarding the collection of expenses related to the search for the defendant or the debtor or of his assets or of the child taken from the debtor on the basis of a court decisions, as well as the expenses of keeping The authors highlight the existence of theoretical and practical issues regarding the examination the assets seized from the debtor and the assets of the debtor evicted from his residence. by the courts in the writ procedure of these type of requests and the lack of specific domain regulations and the authors launch proposals to ensure the coherence of the legal norms in writ proceedings for the related category of claims. The used research methods include: the analysis of the provisions of acting civil procedure laws, the analysis and synthesis of the existing judicial practice in the field of collection of this category of expenses through writ proceedings.
