STATUSUL CONSTITUȚIONAL AL CETĂȚEANULUI ÎN PROCESUL ELECTORAL CONTEMPORAN

Abstract

Drepturile și libertăţile omului, libera dezvoltare a personalităţii umane reprezintă valori supreme și sunt garantate de Constituţia Republicii Moldova (art.1, alin.(1). Printre drepturile fundamentale constituţionale un rol decisiv оl joacă dreptul de vot, dreptul de a alege, ca pвrghie democratică de exercitare directă a suveranităţii naţionale. Tocmai din aceste motive organizarea și desfășurarea alegerilor constituie piatra de temelie a cristalizării statului de drept și democratic оn baza principiilor separaţiei puterilor оn stat, legalităţii și legitimităţii puterii.Human rights and freedoms, open development of human personality represent supreme values are guaranteed by the Constitution of the Republic of Moldova stipulates (art. 1, para. (1). Among the fundamental constitutional rights a decisive role has played the vote right, the right to vote, as a democratic leverage for the exercise of national sovereignty. Precisely for these reasons for organization and conducting of the elections constitutes the cornerstone of crystallization of the law rule and democratic principles based on the separation of state powers, legality and power legitimacy.
