Abstract

In the theory of criminal law, the legal nature of criminal participation was and is being discussed.One of them, which is supported by most criminalists and adopted by most criminal codes, is the crime unit. It is considered that all participants are responsible for the same crime, because participation is not a crime, but a way of committing it.Antother point of view is that of complicity, a distinct crime, according to which, in case of participation, as many crimes are committed as ther are participants.
