The main purpose of this paper is to identify and examine the sources of divergence that appear in the use of AI by the actors in the public sector, mainly, and the private sector. Another purpose is to reflect the challenges and consequences of using this system and, finally to reveal the solution that could respond to the potential problems. Certainly, we are witnessing one of the fastest transitions of civilization, this digital age providing us an undeniable source of progress, but it can also present many risks to human rights, such as the violation of privacy. Considering the complexity of human rights, the real challenge for the experience is to establish a legislative framework that provides protection against risks in the online environment.en
