Abstract

The rapid advancement of technology in recent decades has not only brought significant innovations but also new legal challenges, particularly in the realm of cybercrime. This comparative analysis examines the legislation concerning the production, import, marketing, or illegal provision of technical means or software products, specifically in accordance with Article 260 of the Penal Code of the Republic of Moldova. By comparing the national legislations of various countries, including Germany, Romania, the Netherlands, the United Kingdom, and China, this study aims to identify the differences and similarities in legislative approaches to combat cybercrime. The analysis highlights the effectiveness of these measures, the jurisdictional challenges, and the need for international cooperation to address the transnational nature of cyber offenses. It also discusses the impact of significant international legal frameworks, such as the Council of Europe's Convention on Cybercrime, on shaping national laws. The findings underscore the importance of adaptive and robust legal responses to the evolving landscape of cyber threats, emphasizing the need for a cohesive global legal framework to effectively prevent and combat cybercrime.
