Abstract

This study aims to identify the principles and criteria that allow the individualization of criminal sanctions established for different categories of participants involved in the commission of the criminal offence. Equally, do we aim to find out whether the perpetrator (co-perpetrator) of the offence should benefit from identical or differentiated sanctioning treatment in relation to the organizer, instigator or accomplice? For this reason, was studied the judicial practice of the national courts related to the offences committed in participation, being observed what are the trends in the field.
