Anvergura constituțională a politicii statului în sfera relațiilor sociale [Articol]

Abstract

The basic objective of this study is to identify the role of the state in the sustainable development of society, the concept of the social state that best corresponds to the traditions and exigencies of the modern world in this context. Noting that the Republic of Moldova assumes specific tasks of the social state, although this notion is not claimed in the text of the Fundamental Law, it is argued the need to research the constitutional dimension of the state policy in the sphere of social relations. It is found that the constitutional foundation of the social policies promoted by the contemporary state should involve important aspects, including: the provision of social services to individuals regardless of their social status; regulation of social relations on the basis of equality and respect for their interests; establishment of prescriptions on material assistance to vulnerable persons or on overcoming social inequality. It was established that the constitutional scope of state policy in the sphere of social relations must ensure the balance between the protection of the fundamental rights of the individual and the state intervention to ensure social cohesion and equity.

Obiectivul de bază al acestui studiu este de a identifica rolul statului în dezvoltarea durabilă a societății, conceptul de stat social care corespunde cel mai bine tradițiilor și exigențelor lumii moderne în acest context. Constatând că Republica Moldova își asumă sarcini specifice statului social, deși această noțiune nu este revendicată în textul Legii fundamentale, se argumentează necesitatea cercetării dimensiunii constituționale a politicii statului în sfera relațiilor sociale. Se constată că fundamentul constituțional al politicilor sociale promovate de statul contemporan trebuie să implice aspecte importante, printre care: furnizarea de servicii sociale persoanelor fizice indiferent de statutul lor social; reglementarea relațiilor sociale pe bază de egalitate și respect pentru interesele acestora; stabilirea de prescripţii privind asistenţa materială a persoanelor vulnerabile sau privind depăşirea inegalităţii sociale. S-a stabilit că sfera constituțională a politicii de stat în sfera relațiilor sociale trebuie să asigure echilibrul între protecția drepturilor fundamentale ale individului și intervenția statului pentru asigurarea coeziunii și echității sociale.
