Reglementarea juridică privind plasarea în câmpul muncii a străinilor [Teză]

Abstract

Scopul lucrării: constă în realizarea unei cercetări aprofundate a situațiilor ce reclamă necesitatea plasării în câmpul muncii a cetățenilor străini și a modalităților de reglementare juridică ce se aplică în cazurile de încheiere a raporturilor juridice dintre aceste persoane și angajatorii autohtoni prin prisma instrumentelor internaționale, a legislației naționale și a opiniilor doctrinare.Obiectivele cercetării: obiectivele de bază ale prezentului studiu constau în următoarele: analiza doctrinei de specialitate și a lucrărilor care au abordat problemele privind angajarea cetățenilor străini pe teritoriul altor state, analiza cadrului legislativ al RM aplicabil în situațiile referitoare la plasarea în câmpul muncii a cetățenilor străini, analiza drepturilor și obligațiilor în sfera muncii a angajatorului moldovean în cazul încadrării cetățenilor străini, definirea noțiunii de cetățean și lucrător străin, analiza multiaspectuală a contractului individual de muncă cu element de extranietate ce se încheie de către angajatorul autohton cu un cetățean străin, prezentarea particularităților material-financiare de plasare în câmpul muncii din RM a cetățenilor străini, precum și formularea propunerilor de lege ferenda, întru perfecționarea cadrului legislativ național. Noutatea și originalitatea științifică a lucrării constă în faptul că aceasta reprezintă primul studiu amplu autohton în care s-a încercat să realizăm o analiză complexă a problemei ce vizează reglementarea juridică privint plasarea în câmpul muncii a străinilor pe teritoriul RM. În procesul elaborării prezentului studiu s-a făcut trimiterea la o varietate de opinii și concepții doctrinare. A fost scos în evidență unele eficiențe ale cadrului legislativ național și înaintarea propunerii de lege ferenda care ar spori eficiența la plasarea în câmpul muncii a străinilor. Problematica științifică soluționată constă în tratarea multiaspectuală a cazurilor și, implicit, problemelor privind reglementarea juridică în RM a muncii străinilor pe teritoriul țării, prin prisma instrumentelor inter-naționale, a legislațiilor RM, României și, tangential, Austriei, ceea ce a contribuit la evidențierea lacunelor legislative existente în cadrul normativ moldovenesc, în vederea cizelării și racordării acestora la standardele internaționale actuale în domeniu. Целью данного исследования является проведение исчерпывающего исследования ситуаций, возникающих в связи с необходимостью размещения иностранных граждан на молдавском трудовом рынке и правового регулирования применяемого в ситуациях заключения трудовых отношений с такими лицами с участием местных работодателей. Основными задачами исследования являются - анализ специализированной доктрины и других работ по теме исследовавших размещение иностранных граждан на территории других государств; полный анализ правовых норм РМ, применяемых в ситуациях трудоустройства иностранных граждан; анализ прав и обязанностей молдавского работодателя в отношениях, связанных с трудоустройством иностранных граждан; проведение мульти-уровневого анализа индивидуального трудового договора, заключенного молдавским работодателем с иностранным гражданином; представление материально-финансовых особенностей, предоставляемых в связи с размещением иностранных граждан на молдавском рынке труда, а также формулировка законодательных предложений направленных на совершенствование молдавской законодательной базы, применимой к регулированию работы иностранцев на территории Республики Молдова. Научная новизна и оригинальность работы заключается в том, что она представляет собой первое объемное отечественное исследование, в рамках которого был проведен комплексный анализ вопроса о правовом регулировании трудового размещения иностранцев на территории Республики Молдова. Новизна объясняется тем фактом, что анализ, проведенный для исследования ситуаций размещения иностранных граждан на молдавском рынке труда, охватил различные доктринальные мнения и концепции, посредством которых были выявлены основные недостатки молдавской законодательной базы, которые были опосредованными широким спектром законодательных предложений, наличие и полезность которых повысили бы эффективность применимости правовой базы, применяемой на территории Республики Молдова в случаях, связанных с размещением иностранцев на рынке труда. Решенная научная проблема состоит в многогранном подходе и анализе случаев и, соответственно, проблем правового регулирования труда иностранцев на территории Республики Молдова, на основе как международных правовых инструментов, так и законодательства Республики Молдова, Румынии и, косвенно Австрии, что привело к обнаружению законодательных пробелов в действующем законодательстве РМ, для их совершенствования и при-равниванию к современным международным стандартам. The purpose of the work: consists of conducting an in-depth research into the situations that require the em-ployment of foreign citizens and the legal regulation methods that apply in cases of concluding legal relation-ships between these persons and local employers through the prism of international instruments, national leg-islation and doctrinal opinions. Research objectives: the basic objectives of this study consist of the following: analysis of the specialized doctrine and works that addressed the issues regarding the employment of foreign citizens on the territory of other states, analysis of the legislative framework of the Republic of Moldova applicable in situations related to the employment of foreign citizens, analysis of the rights and obligations in the sphere of labor of the Mol-dovan employer in the case of the employment of foreign citizens, definition of the notion of citizen-foreign worker, multi-aspect analysis of the individual employment contract with an element of foreignness concluded by the local employer with a foreign citizen, presentation of the material and financial particularities of the employment of foreign citizens in the Republic of Moldova, as well as formulation of proposals de lege ferenda, in order to improve the national legislative framework.The novelty and scientific originality of the work lies in the fact that it represents the first large-scale domestic study in which an attempt was made to carry out a complex analysis of the problem concerning the legal regu-lation of the employment of foreigners on the territory of the Republic of Moldova. In the process of developing this study, reference was made to a variety of opinions and doctrinal concepts. Some efficiencies of the national legislative framework were highlighted and the proposal of a lege ferenda was put forward that would increase the efficiency of the employment of foreigners. The scientific problem solved consists of a multi-aspect treatment of cases and, implicitly, problems regarding the legal regulation in the Republic of Moldova of the work of foreigners on the territory of the country, through the prism of international instruments, the legislation of the Republic of Moldova, Romania and, tangentially, Austria, which contributed to highlighting the existing legislative gaps in the Moldovan regulatory framework, in order to refine and align them with current international standards in the field. The theoretical significance of the work lies in conducting a complex, interdisciplinary and multilateral re-search into cases of employment of foreigners in the context of the legislative regulations of the Republic of Moldova on special labor and the general legislative framework. Thus, the theoretical value of this study is scientifically substantiated by approaching the legal institution regarding the regulation of the work of foreign-ers on the territory of the Republic of Moldova, with the definition of the multiple legal-legal notions and concepts that make up the regulatory-normative basis of situations involving the participation of the labor force of foreign origin.
