ADAPTAREA REPUBLICII MOLDOVA LA ERA DIGITALĂ DUPĂ MODELUL UE ÎN CONTEXTUL RESPECTĂRII DREPTURILOR OMULUI

Abstract

The trend in respect of human rights applicable online, the digital sphere, or the Internet, involves the attention of a growing number of human rights organizations, lawyers and civil society, who claim that digital rights are the same as traditional rights, but applicable in another environment. Currently, increased attention is paid to the promotion of children’s safety in the online environment, which in most developed countries has become a prerogative of the state. In this sense, the UN Human Rights Council, through its resolutions, states that people have the same rights, both offline and online, which must be protected. In this article, the author formulated a hypothesis, the justification of which is carried out according to the following scheme: the interpretation of digital human rights is conceptualized as an extension of the traditional ones; their structure and particularities are analyzed, which determine a separate notion, and it is proposed that cyberspace be treated as a platform for which, there is no need to invent new human rights, but solutions must be found to adopt a set of tools that would expand already existing human rights in the virtual space as well, especially given that on June 23, 2022, the Republic of Moldova was offered the status of a candidate for accession to the European Union. Thus, the protection of personal data is of major importance, which is a fundamental right, not only enshrined in national legislation, but also in the Charter of Fundamental Rights of the EU and in the Treaty on the Functioning of the European Union.
