Abstract

Autorul scoate în evidenţă actele de concurenţă neloială și supune analizei acţiunile necinstite ale unui agent economic care constituie fapte ce sunt de natură să creeze, prin orice mijloc, o confuzie cu întreprinderea, produsele sau activitatea industrială sau comercială a unui concurent. Astfel de practici neoneste au făcut obiectul diverselor analize economice și juridice care au demonstrat efectul negativ al actelor de concurenţă neloială asupra economiei. Soluţiile juridice corecte pe marginea acestor cazuri conduc cu certitudine la instaurarea unei practici judiciare constante care nu va admite emiterea unor hotărâri ambigue în materia actelor de concurenţă neloială.The author highlights the acts of unfair competition and subjects to the analysis the unfair actions of an economic agent that constitute facts that are liable to create, by any means, a confusion with the enterprise, products or industrial or commercial activity of a competitor. Such unfair practices have been the subject of various economic and legal analyses that have demonstrated the negative effect of the acts of unfair competition on the economy. The correct legal solutions on these cases lead with certainty to the establishment of a constant judicial practice that will not allow the issuance of ambiguous judgments in the matter of acts of unfair competition.
