LEGEA APLICABILĂ OBIECTELOR DE PROPRIETATE INTELECTUALĂ ÎN DREPTUL INTERNAȚIONAL PRIVAT

Abstract

Reglementarea obiectelor de proprietate intelectuală de către dreptul internațional privat la etapaactuală de dezvoltare a relațiilor sociale reprezintă o necesitate, or, ținând cont de fenomenul globalizării și digitalizării, posibilitatea încălcării în orice stat, decât cel unde a fost creată opera, impune necesitatea studierii legii aplicabile obiectelor de proprietate intelectuală. În această ordine de idei, prezentul articol se axează pe determinarea obiectelor de proprietate intelectuală, cercetarea legii aplicabile obiectelor de proprietate intelectuală în dreptul internațional privat ca și excepție de la regula generală lex rei sitae și are drept scop scoaterea în evidență a tendințelor existente în reglementările statelor cu privire la protecția operelor de creație intelectuală, soluțiile în privința conflcitelor de norme precum și reflecția practicii judiciare internaționale de protejare a proprietății intelectuale prin prisma dreptului internațional privat.Legal regulation of the objects of intellectual property by the International Private Law represent in our days a necessity, taking into account the phenomenon of globalization and digitalization, the possibility of infringement in any state the intellectual property imposes the need to study the law applicable to the objects of intellectual property. In this sense, this article focuses on determining the objects of intellectual property, researching the law applicable to the objects of intellectual property in private international law as an exception to the general rule lex rei sitae and aims to highlight the trends existing in state`s regulations regarding the objects of intellectual property and the solutions regarding the conflicts of norms as well as the reflection of the international judicial practice to protect the intellectual property through the prism of the private international law.La réglementation des droits de propriété intellectuelle par le droit international privé, au stade actuel du développement des relations sociales, est toutefois nécessaire, si l'on tient compte du phénomène de la mondialisation et de la numérisation de la possibilité d'infraction dans tout autre pays que celui où elle a été créée, le safari exige l'étude du droit applicable à la propriété intellectuelle. Dans ce contexte, le présent article se concentre sur la détermination des objets de propriété intellectuelle, sur la recherche de la loi applicable aux objets de propriété intellectuelle en droit international privé, en tant qu'exception à la règle générale de la lex rei sitae, et vise à mettre en évidence les tendances dans les États en ce qui concerne la protection des oeuvres de création intellectuelle, les recours en matière de conflit des règles, ainsi que le reflet de la pratique de la protection judiciaire internationale de la propriété intellectuelle à travers le prisme du droit international privé.Регулирование объектов интеллектуальной собственности международным частным правом на нынешнем этапе развития социальных отношений является необходимостью, поскольку, учитывая феномен глобализации и оцифровки, возможность нарушения в любом государстве, кроме того, где была создана работа, требует изучения закона, применимого к объектам интеллектуальной собственности. В этой связи данная статья посвящена определению объектов интеллектуальной собственности, исследованию закона, применяемого к объектам интеллектуальной собственности в международном частном праве, в качестве исключения из общего правила lex rei sitae, и направлена на выявление существующих тенденций в правилах государств о защите произведений интеллектуального творчества, решениях в отношении свершений норм, а также отражении международной судебной практики защиты интеллектуальной собственности через призму международного частного права.
