| dc.description.abstract | The Legislature has defined the worsening of criminal liability for illegal practice of financial activity, which caused significant material damage, in para (2) art. 241 1 of the Moldovan Criminal Code. In contradictory fashion, one should note that the mechanism of committing the crime related to illegal practice of financial activity does not imply the occurrence of injurious effects. Likewise, one should emphasise that the danger and in- jurious level of crime subject to review does not arise from the injurious effects stated in the incriminating body-text. Such danger arises from the violation of the imperative legal provisions concerning registration and/or obtaining authorisation. Otherwise, the fact of causing significant material damage shall not be absorbed by the illegal practice of financial activity. | en |
