LEGĂTURA CAUZALĂ – O CONDIŢIE OBLIGATORIE PENTRU RECUNOAŞTEREA CA PARTE CIVILĂ ÎN CADRUL UNUI PROCES PENAL

Abstract

In the judiciary practice, exercising the civil action in the framework of the penal process generates discussions concerning the interpretation by some criminal prosecution representatives in the field of the applied conditions, concerning the civil part constitution. In the present article the author analyzes a recently examined case, which puts into discussion the problem available in practice as to the constitution of the person as a civil part and its solution by the the criminal prosecution body, when the invoked prejudice is not connected with de causality of the crime.
