CONCURSUL ȘI CONCURENȚA NORMELOR ÎN CAZUL INFRACȚIUNILOR DE FALS ÎN ACTE PUBLICE ȘI UNELE INFRACȚIUNI CONTRA PATRIMONIULUI

Abstract

In the present study is analyzed the issue of multiple offences and competition of the norms provided in art.332 of the Criminal Code of the Republic of Moldova in relation to some norms that criminalize criminal acts against the patrimony (fraud, embezzlement of foreign property). Qualifying solutions are presented when the forgery in public acts is committed in order to conceal, commit or facilitate the commission of crimes against property. It is shown that in the case of multiple offences with etiological connection (form of the multiple offences with connection), taking into account the rule stipulated in art. 114 of the Criminal Code of the Republic of Moldova, those committed require qualification: according to art. 332 of the Criminal Code of the Republic of Moldova and according to the norm that criminalizes the crime whose commission was facilitated by committing forgery in public acts (as the case may be, according to art. 26 or 27 of the Criminal Code of the Republic of Moldova).
