Abstract
Dreptul la instruire este unul din drepturile fundamentale ale omului, a cărui importanţă a fost conturată într-o lume aflată în permanentă schimbare. Acesta constituie posibilitatea de dobândire a altor drepturi, de vreme ce doar persoanele care au fost supuse educaţiei pot beneficia de instrumentele juridice și economice necesare pentru a lupta cu sărăcia, cu discriminarea socială
și economică, cu alte încălcări ale drepturilor omului.
Importanţa dreptului la instruire se conturează perfect
și în domeniul sistemului penitenciar, care trebuie să
evite transformarea condamnatului într-un potenţial
recidivist și să contribuie la resocializarea acestuia. Cu
toate acestea, în realitate accesul la educaţie al persoanelor private de libertate nu este garantat în plenitudinea sa. Acest studiu abordează anumite standarde
privind accesul la educaţie al persoanelor condamnate
la pedepse privative de libertate, stabilite în sistemul
Convenţiei Europene a Drepturilor Omului din optica
naturii fundamentale a dreptului garantat de art. 2 din
Protocolul nr. 1.
The right to education is one of the fundamental human rights, whose importance has been out - lined in a constantly changing world. It represents an opportunity to acquire other rights, since only persons who have been educated are entitled to benefit from the legal and economic instruments necessary to fight poverty, social and economic discrimination and other human rights violations. The importance of the right to education also fits perfectly in the area of prison system, which shall avoid the convicted person in becoming a recidivist and contribute to his resocialization. However, in reality access to education of persons deprived of liberty is not fully guaranteed. This study focuses on certain standards regarding the access to education of persons serving custodial sentences as established in the system of the Eu- ropean Convention on Human Rights in light of the fundamental nature of the right guaranteed by article 2 of Protocol no. 1.
