AMNISTIA ÎN FAZA DE JUDECATĂ – ÎNCETAREA PROCESULUI PENAL SAU LIBERAREA DE PEDEAPSA?

Abstract

In the article, the author analyzes the effects of the 2021 amnesty applied to the court of appeal in 2022-2023 and the solutions of the courts. Thus, the whole range of specific legal consequences of the amnesty is analyzed which arise in the trial phase at the stage of ordinary appeals, as well as at the later stage. The need to analyze the topic arose following the examination of a considerable number of criminal cases and the adoption by the courts of different solutions regarding the application of the effects of the amnesty law adopted in 2021. Through this study, we want to provoke further analysis and discussion on this topic.
