dc.description.abstractThe principle non reformatio in pejus means that it can’t be created for the appellant a worse situation that the one before the judgment under appeal besides if he expressly consents to this one or in the cases specifically provided by law. The necessity of this rule is explained in the following way: the purpose of the civil trial is not to find the material truth as in the case of the criminal trial, but the solution by which to determine which of the two parties is right.en
