Abstract

Unlike some European Union Member States, the Republic of Moldova cannot “boast” an enduring constitutional tradition. Most of the constitutions in its history were adopted or imposed in a way that did not reflect national specificity. Despite attempts to popularize the principles of European constitutionalism, this phenomenon is still perceived as one implemented “from above”. Continuing to be perceived as a more abstract category for a good part of society, the Constitution is, in this respect, more a law of the state rather than of civil society. This situation urges the need to identify the patterns specific to the process of naturalization” of the essence of our Constitution, through a deep understanding of its normative content. The present study is based on a qualitative methodology, specific to research in the field of legal sciences, based on documentary, comparative, and interpretative analysis of sources of constitutional law and specialized literature. The research methods used were analytical method, comparative method, hermeneutic method, historical method. Such a multidimensional approach made it possible to understand the essence and normative content of the Constitution from both theoretical and applied perspectives.
