PROBLEME TEORETICO-PRACTICE LA CĂUTĂREA PÂRÂTULUI ÎN CADRUL PROCESULUI CIVIL

Abstract

„Căutarea pârâtului” constituie o importantă garanţie procesuală instituită de legiuitor în favoare pârâtului. Desconsiderarea acestei garanţii poate avea majore repercusiuni procesuale, chiar şi prin casarea hotărârii pronunţate, motiv pentru care înţelegerea acestui mecanism prezintă o deosebită importanţă, atât din punct de vedere teoretic, cât şi practic. Prezenta lucrare urmăreşte drept scop examinarea mecanismului „Căutării pârâtului” pentru a determina cazurile, procedura şi condiţiile realizării căutării pârâtului, dar cel mai important - pentru a evidenţia consecinţele nerespectării acestei garanţii procesuale, precum şi posibilităţile de îmbunătăţire legislativă a mecanismului dat.„Search of the defendant” represents an important procedural guarantee established by the legislator in favor of the defendant. Inconsideration of such a guarantee may have important procedural repercussions, even being a reason for quashing a court judgment, which is why understanding this mechanism is primarily both, from the theoretical and practical points of view. The present study follows the goal of throughout examination of the “Search of the defendant” procedure in order to bring out grounds and mechanism of its realization, but most importantly to highlight the consequences of infringement of such a procedural guarantee and examine possibilities of improving this legal mechanism.
