MARJA DE APRECIERE A STATELOR ÎN PROCESUL DE EXECUTARE A HOTĂRÂRILOR CURȚILOR INTERNAȚIONALE ÎN DOMENIUL DREPTURILOR OMULUI

Abstract

În sistemul european de protecţie a drepturilor omului statele beneficiază de o marjă de apreciere în procesul de executare a hotărârilor pronunţate împotriva lor de către Curtea Europeană a Drepturilor Omului, spre deosebire de sistemul american și cel african, or, Curtea Interamericană a Drepturilor Omului și Curtea Africană a Drepturilor Omului și Popoarelor au împuterniciri mai vaste, care, în mod implicit, duc la limitarea marjei de apreciere a statelor reclamate. Totuși, aceste trei sisteme nu sunt lipsite de asemănări în contextul dat.

In the European system of human rights pro- tection states benefit from a margin of appre - ciation in the process of executing judgments delivered against them by the European Court of Human Rights, unlike the American and African systems; the Inter-American Court of Human Rights and the African Court on Hu- man and Peoples’ Rights have broader powers that implicitly limit the margin of appreciation of the respondent states. Nevertheless, these three systems are not without similarities in the present context.
