REALIZAREA DREPTULUI LA PROTECŢIA DATELOR CU CARACTER PERSONAL

Abstract

The recent institutionalisation of protection of data with a personal character as a juridical reality in the Republic of Moldova determines the necessity of the elaboration of some evaluation studiies of the regulation framwork and the interpretation of the prescribed norms. The defense of the right of protection of data with a personal character is a rather important subject, because the existence of such a mechanism contributes to the realization de facto of the law. There have been analyzed the modalities of defending the of the right of data protection with a personal character, institutionalized and state defense; instruments that can be utilized by the subject referred in the realization of defense. Some norms are proposed to be introduced in the chapter “the obligations of the operator” in order to take adequate measures as to the protection of data with personal character.
