JURISPRUDENȚA CURȚII CONSTITUȚIONALE PRIVIND VIOLENȚA ÎN FAMILIE

Abstract

This article analyzes the jurisprudence of the Constitutional Court of the Republic of Moldova regarding domestic violence. It was noted that the issues put before the Constitutional Court concerned: a) the alleged lack of criminalization of psychological violence; b) if domestic violence between ex-spouses is possible; c) the impossibility of applying a contraventional sanction for family violence committed by persons who have reached the general retirement age; and d) the alleged unpredictability of the „insignificant injury to bodily integrity” text. However, the Constitutional Court did not declare any provision unconstitutional.
