DESPRE INSTITUŢIA PROBAŢIUNII ÎN DREPTUL CONTRAVENŢIONAL

Abstract

În această publicaţie au fost analizate aspectele teoretico-practice privind constatarea faptelor contravenţionale de organele de probaţiune şi intervenţia socio-pedagogică a acestei instituţii în procesul de executare a unor pedepse contravenţionale. Lucrarea este caracterizată printr-o combinaţie din stabilirea faptelor şi supravegherea/ asistenţa contravientului. Un compartiment aparte a fost dedicat caracteristicii juridice a contravenţiilor constatate de probaţiune prin prisma elementelor constitutive contravenţionale. Elaborarea acestui material s-a dorit a fi de utilitate atât pentru viitorii jurişti, cât şi pentru alte persoane interesate.In this publication were analyzed the theoretical and practical aspects regarding the finding of contraventional facts by the probation bodies and the socio-pedagogical intervention of this institution in the process of execution of contravention penalties. The work is characterized by a combination of setting facts and supervising / assisting the contravenient. A separate section was dedicated to the legal feature of contraventions found by probation in terms of contravention constitutive elements. The elaboration of this material was intended to be of use to both future jurists and other interested parties.
