Abstract
The rule of law, democracy and fundamental rights constitute the normative core of the European Union and the essential condition for the functioning of the European legal order. The article analyses the mechanisms through which the European Union monitors, evaluates and protects respect for these values in the Member States, as well as in its external action. It examines the legal foundations enshrined in the Treaty on European Union, the Treaty on the Functioning of the European Union and the Charter of Fundamental Rights of the European Union, with a focus on Articles 2, 3, 7 and 21 TEU, Articles 258–260 TFEU, and the role of the Charter in protecting fundamental rights. The research highlights the main European instruments: the procedure under Article 7 TEU, infringement proceedings, the annual Rule of Law Report, the reports of the European Union Agency for Fundamental Rights, the rule of law conditionality regime for the protection of the EU budget, strategies for strengthening the application of the Charter, instruments for protecting media freedom and mechanisms for promoting democracy. The article underlines that these mechanisms play an essential role in preventing democratic backsliding, combating corruption, protecting judicial independence, guaranteeing media freedom and strengthening mutual trust among Member States. At the same time, it finds that their effectiveness depends on the political will of the Member States, the institutional coherence of the EU and the Union’s ability to transform monitoring into concrete corrective action.
