DREPTUL FUNDAMENTAL LA ÎNVĂȚĂTURĂ ÎN REPUBLICA MOLDOVA

Abstract

Scopul lucrării și obiectivele: Scopul lucrării constă în elaborarea unui studiu complex privind dreptul fundamental la învățătură, prin prisma conţinutului şi naturii juridice ce reies din obligațiile pozitive și negative ale statului în procesul realizării dreptului fundamental la învățătură. Principalele obiective ale lucrării: cercetarea fenomenului recunoașterii dreptului fundamental la învățătură la nivel național, regional și internațional, sub aspect evolutiv; studierea concepțiilor cu privire la natura juridică a dreptului fundamental la învățătură în raport cu alte drepturi; determinarea conținutului multidimensional al dreptului fundamental la învățătură; motivarea naturii sociale a dreptului fundamental la învățătură; investigarea impactului dreptului fundamental la învățătură asupra altor drepturi; identificarea raporturilor juridice de realizare a dreptului fundamental la învățătură; investigarea cazurilor practice de aplicare a garanțiilor juridice speciale în scopul exercitării obligațiilor pozitive și negative ale statului; formularea unor recomandări privind garantarea dreptului fundamental la învățătură.

The purpose of the work and objectives: the aim of the paper consists in the elaboration of a complex study on the fundamental right to education, in terms of the content and legal nature arising from the positive and negative obligations of the state in the process of achievement of the fundamental right to education. The main objectives of the work include: the research on the phenomenon of the recognition of the fundamental right to education at the national, regional and international level, in the evolutionary framework; the study of conceptions about the legal nature of the fundamental right to education in relation to other rights; the determination of the multidimensional content of the fundamental right to education; the substantiation of the social nature of the fundamental right to education; investigating the impact of the fundamental right to education on other rights; the identification of legal relations for the realization of the fundamental right to education; the investigation of practical cases of application of special legal guarantees in the process of performing of the positive and negative obligations of the state; formulating recommendations on guaranteeing the fundamental right to education.

Цель диссертации и задачи: Целью диссертации является всестороннее исследование фундаментального права на образование, через содержания и правовой природы, вытекающих из положительных и отрицательных обязательств государства в процессе реализации фундаментального права на образование. Основными задачами диссертации являются: исследование феномена признания фундаментального права на образование на национальном, региональном и международном уровнях, в своей эволюции; изучение концепций о правовой природе фундаментального права на образование по сравнению с другими правами; определение универсального содержания фундаментального права на образование; обоснование социальной природы фундаментального права на образование; исследование влияния фундаментального права на образование на других правах; выявление правовых отношений в реализации фундаментального права на образование; расследование случаев практического применения специальных правовых гарантий, в процессе выполнения положительных и отрицательных обязанностей государства; разработка рекомендаций по обеспечению фундаментального права на образование.
