ACCESUL CONDAMNAŢILOR LA INTERNET

Abstract

In the Republic of Moldova, detainees are prohibited from accessing the Internet. Even so, some convicts ask the prison administration for access to the Internet. Such requests are rejected. This study analyzes the access of convicts to the Internet through the jurisprudence of the European Court of Human Rights and the Constitutional Court. In this sense, it is concluded that the access of convicts to the Internet does not constitute a distinct right guaranteed by the Constitution or the European Convention on Human Rights.

În Republica Moldova, deţinuţilor li se interzice accesul la Internet. Chiar și așa, unii condamnați cer de la administraţia penitenciarului accesul la Internet. Astfel de cereri sunt respinse. Acest studiu analizează accesul condamnaților la Internet prin prisma jurisprudenței Curții Europene a Drepturilor Omului și a Curții Constituționale. În acest sens, se conchide că accesul condamnaților la Internet nu constituie un drept distinct garantat de Constituție sau de Convenția Europeană a Drepturilor Omului.
