INFORMAȚIA COMPUTERIZATĂ – OBIECT IMATERIAL AL INFRACȚIUNILOR PREVĂZUTE LA ART. 259 CP RM

Abstract

For the purposes of art. 259 of the Criminal Code of the Republic of Moldova, computerized information is information intended for processing on a computer, fixed on a medium that can be read by a computer or transmitted in an environment that makes it possible to interact within a computer system or computer network. Computer data is meaningful to the recipient. Without the receiving subject, the computer data remains only computerized information. The syntagma “computer data” is used in other articles in Chapter XI of the special part of the Criminal Code of the Republic of Moldova (e.g. in art. 2601-2603, 2605 and 2606). In addition, the notion of “computer data” is defined in art. 2 of Law no. 20/2009. It is necessary that in art. 259 of the Criminal Code of the Republic of Moldova the phrase “computerized information” to be replaced by the words “computer data”. Also, Chapter XIII of the special part of the Criminal Code of the Republic of Moldova must be completed with art. 13421 which would have formulated the definition of the notion “computer data”.
