The complaints against the illegal actions and acts of the criminal prosecution authority and of the authorities that conduct the special investigative activity are examined by the investigating judge within the framework of the judicial control of the prejudicial stage. The legislator did not regulate strictly the criteria and limits of investigation in the procedure of the examination of complaints submitted in the order of the art. 313 CPC, and the judicial practice in this respect is non-uniform.
