SOLICITAREA DE CATRE APARATOR A OPINIEI SPECIALISTULUI PENTRU EXPLICAREA CHESTIUNILOR CARE NECESITĂ CUNOŞTINŢE SPECIALE

Abstract

Acordând asistenţă juridică calificată clientului, apărătorul trebuie să-şi îndeplinească cinstit, conştiincios, cu bună-voinţă, principial şi la momentul oportun propriile obligaţiuni în vederea promovării interesului celui acuzat. Din acest considerent, figurând în calitate de subiect al strângerii probelor, avocatul este obligat, în caz de necesitate, să antreneze specialistul în vederea obţinerii de consultaţii asupra oricăror chestiuni care apar pe durata desfăşurării procesului penal, lămurirea cărora necesită cunoştinţe speciale. În prezentul studiu autorul se referă la posibilităţile pe care le are astăzi apărătorul, reieşind din pct. 3) alin. (2) art.100 din CPP al R. Moldova.

By providing qualified legal assistance to the client, the lawyer must be honest, careful, vigilant and at the right time to fulfill his own obligations in order to promote the interest of the accused. For this reason, as a subject of gathering the evidence, the lawyer is obliged, in case of necessity, to ask the specialist in order to obtain consultations on any issues that arise during the course of the criminal proceeding, the clarification of which requires special knowledges. In the present study the author refers to the possibilities, which the lawyer has today from the point 3), par. (2), Article 100 of the CPP of the Republic of Moldova.
