SPECIFICUL PROCEDURILOR JUDICIARE ÎN LITIGIILE DE STABILIRE A DOMICILIULUI COPIILOR MINORI

Abstract

The article purpose to highlight the specifics of the judicial procedures regarding the establishment of the domicile of the child. The text seeks to identify only some of the main problematic aspects of the resolution of the respective category of disputes. First of all, the analysis highlights the essence, the usefulness of the means of defense, the meaning and the legal effects of the court decision establishing the domicile of the minor child. At the same time, the text analyzes the provisional measures that may be applied in the context of judicial procedures to establish the domicile of the child. Last but not least, the presentations aim to offer solutions regarding the interpretation of the framework laws that regulate the institution of establishing the child's domicile, which correlates both with judicial practice and international standards in the field of child rights protection.
