Suspendarea și încetarea mandatului șefului statului în arhitectura constituțională contemporană a Republicii Moldova [Rezumat]

Abstract

Scopul lucrării constă în cercetarea aprofundată a instituției suspendării și încetării mandatului șefului statului în vederea conturării principiilor și particularităților care le caracterizează, prin realizarea unei abordări comparative a reglementărilor constituționale și a practicii constituționale din Republica Moldova și din alte state cu scopul identificării modelelor constituționale existente și a formulării unor propuneri de lege ferenda pentru perfecționarea cadrului normativ național. Obiectivele cercetării: elucidarea particularităților referitoare la suspendarea mandatului șefului statului; identificarea temeiurilor și condițiilor constituționale ale încetării mandatului șefului statului ca garant al legitimității funcționării mecanismului de stat; analiza comparativă a modelelor constituționale cu privire la mandatul șefului statului, cu evidențierea similitudinilor și deosebirilor de reglementare a suspendării și încetării mandatului; examinarea jurisprudenței relevante a Curții Constituționale în domeniu; elucidarea esenței funcțiilor instituției șefului statului ca instituție etatică și personală în cadrul puterilor de stat.

The purpose of this study is to conduct an in depth analysis of the institutions of suspension and termination of the head of state’s term of office in order to outline the principles and characteristics that define them, by conducting a comparative analysis of constitutional provisions and constitutional practice in the Republic of Moldova and other states, with the aim of identifying existing constitutional models and formulating proposals for future legislation to improve the national regulatory framework. Research objectives: to elucidate the specific aspects regarding the suspension of the head of state’s term of office; to identify the constitutional grounds and conditions for the termination of the head of state’s term of office as the guarantor of the legitimacy of the fun ctioning of the state apparatus; to conduct a comparative analysis of constitutional models regarding the term of office of the head of state, highlighting the similarities and differences in the regulation of the suspension and termination of the term of office; to examine the relevant case law of the Constitutional Court in this area; to elucid ate the essence of the functions of the office of the head of state as both a state institution and a personal office within the framework of state powers.

Цель работы заключается в углублённом исследовании институтов приостановления и прекращения полномочий главы государства с целью выделения принципов и особенностей, путем проведения сравнительного анализа конституционных норм и конституционной практики Республики Молдова и других государств с целью выявления существующих конституционных моделей и формулирования предложений по совершенствованию национального звконодательства. Цели исследования: выявление особенностей, касающихся приостановления полномочий главы государства; определение конституционных оснований и условий прекращения полномочий главы государства; сравнительный анализ конституционных моделей, касающихся полномочий главы государства, с выделением сходств и различий в регулировании приостановления и прекращения полномочий; изучение соответствующей судебной практики Конституционного суда в данной области.
