ANUMITE ASPECTE ALE OBIECTULUI MATERIAL (IMATERIAL) AL INFRACȚIUNILOR PREVĂZUTE LA ART. 259 CP RM

Abstract

The purpose of this study is to establish whether the social values and relations, defended by art. 259 of the Criminal Code of the Republic of Moldova, are harmed by means of the entities: with an exclusively material character; with an exclusively immaterial character; with an material or immaterial character. As a result of the analysis performed, it is concluded that the computerized information (like other such immaterial entities) cannot represent the material object of the crime. The offenses, provided in art. 259 of the Criminal Code of the Republic of Moldova, have: main immaterial object (illegally accessed computerized information); secondary immaterial object (destroyed, damaged, altered, blocked or copied computerized information); secondary material object (computers, computer system or computer network, which has been malfunctioned).
